KITTSON COUNTY BOARD PROCEEDINGS November 5, 2012
The Kittson County Board of Commissioners met, pursuant to adjournment on Monday, November 5, 2012 at 9:00 a.m. All members were present.
The meeting was called to order by Chairman Bouvette. The pledge to the flag was given.
A motion was made by Commissioner Younggren, seconded by Commissioner Olson and unanimously carried to approve the minutes from the October 16, 2012 County Board meeting as written.
Meeting with the County Board was Kenny Hultgren and Kelly Kukowski to discuss a Joint Powers Agreement with BCA.
A motion was made by Commissioner Spilde, seconded by Commissioner Olson and unanimously carried to enter into a Joint Powers Agreement with the Bureau of Criminal Apprehension to provide access to the Minnesota Criminal Justice Data Communications Network.
Meeting with the County Board was Dan Younggren to discuss Beet Growers opposition to a possible fee or permit requirement to cover county road repairs and cleanup.
Meeting with the County Board was Kathy Johnson, Social Services Director, to discuss 2011 Social Services program costs. She also discussed that the County was short on its share Child Support Program Funding and could lose funding as a result. She also explained how pending sequestration cuts could affect the County Budget and that Sanford Health was no longer taking in violent patients.
Meeting with the County Board was Kelly Bengtson, County Engineer. He discussed the status of road construction and maintenance projects, MNDOT 20 Year State Highway Improvement Plan, status of annual County/Township Bridge Inspections, and the status of work on State Ditches 50 & 72. Bengtson discussed his concerns about road damage and mud on the roads due to a wet harvest season. County Board will meet with Commodity Growers in December to discuss road conditions.
A motion was made by Commissioner Olson, seconded by Commissioner Younggren and unanimously carried to approve a utility permit for installation of a storm sewer under CSAH 4 in Lancaster to Bordertown Construction.
A motion was made by Commissioner Anderson, seconded by Commissioner Olson and unanimously carried to approve a utility permit for installation of a 2” rural water line in Cannon Township along east side of CSAH 4 to Glen Anderson.
A motion was made by Commissioner Anderson, seconded by Commissioner Younggren and unanimously carried to approve the final payment voucher to Brian Anderson Construction for SAP 35-599-115 in the amount of $6,049.18.
A motion was made by Commissioner Spilde, seconded by Commissioner Younggren and unanimously carried to approve the final payment voucher to EJR Construction for work completed on Lateral 12 of State Ditch 72 & 50 in the amount of $1,508.51.
A motion was made by Commissioner Olson, seconded by Commissioner Spilde and unanimously carried to approve the final payment vouchers for the 2012 Mowing Contract to Jarred Olson for $2,853.68 and to Comstock Custom Mowing for $906.57.
Meeting with the County Board was Cindy Urbaniak, County Nurse. Cindy presented information on family home visiting and discussed the response to the Karlstad wildfire.
Meeting with the County Board was Olin Phillips, Lori Dowling, Kristi Coughlon, William Glesener and Dave Thomas of the Department of Natural Resources to discuss the recent news articles about DNR’s role at the Karlstad Fire, the high rate of suspicious fires in Kittson County and the need for public support in stopping them, burning permits and back burning and the role of DNR in firefighting in general.
A motion was made by Commissioner Olson, seconded by Commissioner Younggren and unanimously carried to approve the payment of Commissioner Warrants and Auditor Warrants as follows:

A motion was made by Commissioner Younggren and seconded by Commissioner Anderson to adopt the following resolution: #12-31
ASSISTANT COUNTY ATTORNEY
Whereas, Roger C Malm, Kittson County Attorney, is authorized under the provisions of Minnesota law to appoint, with the consent of the County Board, one or more attorneys for assistants in the performance of the duties of County Attorney; and
Whereas, each assistant so appointed is to serve at the pleasure of the County Attorney; and
Whereas, the County Attorney has selected assistants to serve under him who have stated their willingness to serve without pay or salary.
Now, Therefore, this County Board does hereby give its consent to the appointment of Richard M Lee to be the assistant to Roger C Malm, Kittson County Attorney, said assistant to serve without pay or salary of any type at the pleasure of the County Attorney. The County shall not pay for health insurance coverage. The County Attorney shall appoint in writing the assistants named herein and there shall be filed an oath and appointment in the manner prescribed by Minnesota Law.
Voting in favor: Commissioners Younggren, Olson, Bouvette, Spilde and Anderson.
Voting against: none.
A motion was made by Commissioner Younggren, seconded by Commissioner Olson and unanimously carried to re-appoint Eric Ristad and Tracy Bergh to serve a four (4) year term on the Board of North Kittson Rural Water District.
A motion was made by Commissioner Spilde, seconded by Commissioner Anderson and unanimously carried to appoint Eric Christensen as voting delegate to the MCIT annual meeting.
A motion was made by Commissioner Spilde and seconded by Commissioner Anderson to adopt the following resolution: #12-32
RESIDENTIAL ANTI-DISPLACEMENT AND RELOCATION ASSISTANCE PLAN
BE IT RESOLVED, Kittson County Board of Commissioners hereby adopts the Residential Anti-Displacement and Relocation Assistance Plan for Kittson County, Minnesota.
Voting in favor: Commissioners Younggren, Olson, Bouvette, Spilde and Anderson.
Voting against: none.
A motion was made by Commissioner Spilde, seconded by Commissioner Anderson and unanimously carried to adopt the Prohibition of Excessive Force Policy, Drug Free Workplace Certification and Administrative Services Contract with Wynne Consulting.
A motion was made by Commissioner Younggren, seconded by Commissioner Anderson and unanimously carried to accept the letter of resignation from Marilyn Gustafson, Auditor/Treasurer, effective December 31, 2012 with regret and thank her for the many years of service to Kittson County and wish her well on her retirement.
Committee Reports were given.
Eric Christensen, County Administrator, presented information to the Board on the AMC District meeting in Thief River Falls and on the Great Northern Transmission Line meeting in Lancaster.
The Board adjourned to Tuesday, November 20, 2012 at 9:00 a.m.
